Delivery

6.1 You are responsible for ensuring the acceptance of Goods upon their delivery.

6.2 We aim to provide you with an approximate readiness date for delivery of Goods. If a delivery delay arises, we will promptly inform you and offer a revised date. We are not liable for any losses, whether financial or otherwise, resulting directly or indirectly from delay or non-meeting of estimated dates. Unless mutually agreed in writing, delivery time is not a pivotal condition of the Contract. We may, at our discretion, deliver Goods before the quoted date with reasonable notice.

6.3 If we fail to deliver Goods (or any part thereof) for reasons beyond reasonable control or not attributable to you, and we are liable, our liability shall be limited to the excess (if any) of the cost to you (in the most economical market) for similar goods to replace the undelivered ones over the Goods' price.

6.4 Initially, we will deliver your first order of Goods to the registered address of the cardholder, irrespective of any alternative address you may provide. Subsequently, we may endeavour to deliver Goods to alternative addresses at our discretion. Our responsibility ends when Goods are delivered to the registered cardholder's address or any alternative address. Failure to deliver within 90 days or after 3 attempts by us (whichever is earlier) due to reasons deemed to be your fault may lead us, at our discretion, to refund the sum paid by you and cancel the Contract.

6.5 In cases where you neglect to take delivery or provide adequate delivery instructions at the specified time, we reserve the right to store Goods until actual delivery and charge you reasonable costs, including insurance, for storage or subsequent delivery.

6.6 For Goods delivered outside the EU, you assume responsibility for all applicable customs requirements and duties. We bear no liability for these charges, and compliance with importing country laws and regulations is your responsibility. We shall not be held accountable for delivery delays due to customs inspections. By accepting our terms, you agree to reimburse us for any liability stemming from your non-compliance with customs requirements and duties.

 

Warranties and Liability

8.1 Unless expressly stated in these Conditions, and except when Goods are sold to a consumer under the Unfair Contract Terms Act 1977 and the EU Unfair Contract Terms Regulations, all warranties, conditions, or implied terms by statute or common law are entirely excluded within the limits of applicable law. For consumer transactions under the Consumer Protection Act 2007, your legal rights remain unaffected by these Conditions. Consult the National Consumer Agency for further details.

8.2 The warranty mentioned in Clause 8.1 does not apply to defects resulting from fair wear and tear, deliberate damage, accidents, negligence by you or third parties, unauthorised usage of Goods, non-compliance with our instructions, or unauthorised alteration or repair.

8.3 In the unlikely event that Goods do not conform to these Conditions, please inform us promptly. We will either arrange collection or request you to return the Goods at our expense. After confirming the fault, we will provide a full or partial refund, replace the Goods, or repair them.

8.4 Neither party shall be responsible for losses beyond foreseeable consequences arising from non-compliance with these Conditions, subject to clauses 8.6 and 8.7.

8.5 Neither party shall be liable for losses categorised as loss of income or revenue, loss of profit, loss of business, loss of anticipated savings, loss of data, or any time-related waste due to non-compliance with these Conditions. However, this clause 8.6 shall not hinder claims for foreseeable loss of, or damage to, tangible property.

8.7 Our liability is not excluded or limited in any way for death or personal injury due to negligence, fraudulent misrepresentation, breach of obligations implied by section 26 of the Sale of Goods and Supply of Services Act 1980, defective products under The Liability for Defective Products Act 1991, or any other illegal or unlawful exclusions or attempts to exclude liability.
